One Prize Drawing for One Digital Print Given Every Quarter
Terms and Conditions
1) These official rules (“Rules”) apply to the prize drawing (“Prize Drawing”) conducted by Marie Kost 1113 Cherry St. #92768, Seattle, WA 55432 (the “Sponsor”). By entering this Prize Drawing, you agree to be bound by these rules.
2) The retail value of one digital print is $00.00-$82.00.
3) Odds of winning are approximately 1 in 20*. One (1) digital print out of one (1) notice distributed. Winners may not substitute or transfer their prize.
4) No Purchase necessary to enter or win. Entrants do not buy anything to have a chance to win or pay any shipping or handling fees if they are the winner of the prize.
5) (a) During the Promotion Period, any eligible person (as defined in Section 6 of these Rules) who completes the opt-in page (“Entrant”), shall receive entry in the Prize Drawing as follows: Every Entrant will automatically receive one (1) entry for completing the opt-in page (until Entrant unsubscribes from emails or wins the Prize Drawing). (b) Sponsor will conduct one random drawing to award the prize each quarter of the year (March, June, Sept., and Dec.). Sponsor will randomly select one winner from all eligible entries received (if winner was already selected from a previous quarterly drawing, they will not be eligible to win again). The drawing will be conducted at the last day of each quarter. The prize winner will be contacted via email within 17 days. The winner of the prize will be the only one contacted due to privacy policy. Sponsor will make reasonable efforts to notify the winners via email address and send each winner a digital print of their choosing within approximately three weeks of receiving a response from the prize winner via email. In the event: (i) the prize winner does not respond to their e-mail notification within two (2) weeks of receipt of such e-mail or such e-mail notification is returned as undeliverable; (ii) the prize winner’s email address is no longer active: (iii) or the winner does not respond with name, address, and what digital print is chosen (iv) or the winner does not comply with these Rules, then said prize winner shall forfeit their right to the prize and a new random drawing will be conducted to select an alternate prize winner. The process set forth in this subparagraph (b) shall be repeated until the prize has been successfully awarded. (c) All entries become the property of Sponsor and will not be returned or acknowledged. Incorrect, incomplete, late, and any other type of defective entry whatsoever will be automatically disqualified.
6) All legal residents domestic and international: (i) who must be 18 years of age (ii) who have computer access and internet access; (iii) who are invited by Sponsor to complete an opt-in page providing email address associated with the Prize Drawing. Eligible persons will be invited to participate in the respondent opt-in page and must accept such invitation by completing the opt-in page (including all information required and cannot opt out or unsubscribe) associated with the Prize Drawing. One random prize winner is selected every quarter until the sponsor decides to terminate the prize drawing (prize winner cannot win more than one quarter). Entries will be accepted via on-line participation on the opt-in page.
7) Winners may not substitute or transfer their prize. *The odds of winning depend upon the number of eligible entries received.
8) Sponsor may terminate the Prize Drawing or any portion thereof or decide to modify it in any manner, which it deems fair and equitable to participants if it becomes aware of any occurrence, which would materially affect the security, fairness, or proper play of the Prize Drawing. Sponsor may prohibit individuals from participating in the Prize Drawing and disqualify entries if: (i) participants attempt to enter the Prize Drawing through any means other than as described in these Rules; (ii) participants attempt to disrupt the Prize Drawing or circumvent the terms and conditions of these Rules in any way; or (iii) participants repeatedly show a disregard for the Prize Drawing Rules, act in an unsportsmanlike manner, or act with an intent to annoy, abuse, threaten, or harass any other entrant or Sponsor. Sponsor expressly reserves the right to resolve any discrepancies, disputes, or otherwise unforeseen circumstances and Sponsor’s decision will be final. Sponsor expressly reserves the right to change or alter Rules at any time.
9) Neither Sponsor or their respective employees or vendors shall be responsible for any technical, hardware, or software malfunctions, interruptions or unavailability, failed transmissions over any network, failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Prize Drawing, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problems, human error or traffic congestion, unavailable network connections on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Prize Drawing or downloading any materials from Sponsor’s website during this Prize Drawing.
By participating in the Prize Drawing, all entrants agree to release Sponsor, its clients, and their respective vendors and their respective employees from any and all liability for any loss, harm damages, costs or expenses of any kind, including without limitation property damages, personal injury and/or death arising out of participating in this Prize Drawing, or the acceptance, possession, use or misuse of any prize, or while preparing for, participating in and/or traveling to or from any prize related activity and claims based on rights of publicity, rights of privacy, defamation or prize delivery. By entering the Prize Drawing, participants agree to be bound by these Rules and the decisions of Sponsor. Information collected by Sponsor during this Prize Drawing will be used subject to Sponsor’s Privacy Policy.
